Discrimination Laws And Sexual Harassment Lawyers
|
Sexual harassment lawyers defend victims of workplace discrimination of a sexual nature, but they also take cases pertaining to other forms of harassment. These include racial bias or discrimination, termination due to being a woman, a minority or of a specific sexual preference. Others are discrimination or taunting due to mental, physical, or medical conditions. Although women are sexually harassed more often than men, it also happens to male workers. Violating the rights of an employee by expecting sexual favors as a condition for continued employment, verbal and physical demands, touching or other unwelcome advances and creating a hostile work environment, are all illegal. When an employee feels she can no longer perform her job duties due to intimidation of another employee, it is time to file a report with her employer. Sexual harassment lawyers are available online and in the phone book for free advice or consultation pertaining to these matters. Sexual harassment lawyers advise businesses and companies to put into effect the same law California has mandated toward discrimination at work. This law is AB 1825, a sexual training mandate for training employees in identifying, solving and reducing workplace sexual harassment. Companies with 50 or more employees are required by law to offer this type of training. It should be held in a classroom setting or private room and should be taught by a professor of law, attorney with experience in civil rights, or a human resource director. For new hires, training should be completed within 6 months. Sexual harassment lawyers, also may be retained by a company when the company states they are innocent of any charges made against them, or made against a supervisor. The first step in any sexual harassment situation is for the employee to put a stop to the conduct. Plainly telling the offender to stop it should end it. If the offender continues to harass her, she needs to come forward with claims of sexual harassment, At that time, the EEOC will immediately begin an investigation and review all documentation of the incidents. If it is found the employee is indeed a victim, the offending party may receive verbal and written disciplinary actions leading up to termination.
